ARKTOP LLC (“ARKTOP,” “we,” “us,” or “our”) is a digital marketing and web development agency serving luxury retail brands. This notice explains how we collect, use, and disclose personal information about visitors to arktop.com, prospective clients, and people who contact us.

Two related documents cover different situations:

  • Cookie Notice — the cookies and tracking technologies we use on this site, and how to control them.
  • Client Data Processing Terms — how we handle personal information belonging to our clients’ customers when we deliver services. That document forms part of our client agreements.


If you are a customer of one of our clients, please consult that company’s privacy policy. ARKTOP does not control how your information is used in that context.

Interpretation and Definitions

Interpretation

The words with their initial letters capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

Definitions

For the purposes of this Privacy Policy:

  • Account means a unique account created for you to access our Service or parts of our Service.
  • Company (referred to as either “the Company,” “We,” “Us,” or “Our” in this Agreement) refers to Arktop.
  • Cookies are small files placed on your computer, mobile device, or any other device by a website, containing the details of your browsing history on that website among other uses.
  • Device means any device that can access the Service, such as a computer, cellphone, or digital tablet.
  • Personal Data is any information that relates to an identified or identifiable individual.
  • Service refers to the Arktop website arktop.com.
  • Service Provider means any natural or legal person who processes data on behalf of the Company.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • Website refers to the Arktop Website, accessible from arktop.com.
  • You means the individual accessing or using the Service or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Information you give us

When you complete a contact form, request a proposal, schedule an appointment, subscribe to our newsletter, download a resource, or otherwise communicate with us, we collect:

  • Name
  • Business email address
  • Telephone number
  • Company name and website
  • Job title
  • The content of your message and any information you choose to include
  • Marketing preferences


We use this to respond to your inquiry, prepare proposals, provide the services you request, and — where you have opted in or where permitted by law — send marketing communications.

Information collected automatically

When you visit arktop.com, we and our analytics and advertising partners collect:

  • IP address
  • Browser type and version
  • Device type and operating system
  • Referring URL and exit pages
  • Pages viewed, time on page, and scroll depth
  • Approximate geographic location derived from IP address
  • Cookie and pixel identifiers

Information from third parties

We may receive business contact information from:

  • LinkedIn and other professional networks
  • Referral partners and industry contacts
  • Publicly available business directories

Information we do not collect

We do not knowingly collect information from anyone under 18. We do not collect payment card details through this website. We do not collect sensitive personal information such as health data, biometric identifiers, precise geolocation, Social Security numbers, racial or ethnic origin, or religious beliefs.

How we use information

We use personal information to:

  • Respond to inquiries and prepare proposals
  • Provide and administer services under a client agreement
  • Send marketing emails and newsletters, where you have opted in or where permitted by law
  • Measure website traffic and improve site performance
  • Deliver and measure advertising, including remarketing
  • Protect our systems, prevent fraud, and enforce our terms
  • Meet legal, tax, accounting, and regulatory obligations

Who we share information with

We do not sell your personal information for money. Under California law, our use of advertising and analytics cookies may qualify as “sharing” for cross-context behavioral advertising; see Section 6 for how to opt out.

How long we keep information

We retain inquiry and contact records for approximately 24 months from last contact. Client records and correspondence are retained for the term of the engagement plus seven years for tax and legal purposes. Marketing subscriber records are kept until you unsubscribe, plus a further period to honor your opt-out. Website analytics data is retained according to our Google Analytics configuration. Cookie durations are set out in our Cookie Notice.

Your privacy rights

Available to everyone

Wherever you live, you may:

  • Ask what personal information we hold about you
  • Ask us to correct inaccurate information
  • Ask us to delete information we no longer need
  • Unsubscribe from marketing emails using the link in any message

California residents (CCPA/CPRA)

If you are a California resident, you have the right to:

  • Know what personal information we collect, use, disclose, and share, including the specific pieces we hold
  • Delete personal information collected from you, subject to exceptions
  • Correct inaccurate personal information
  • Opt out of sharing your personal information for cross-context behavioral advertising
  • Limit use of sensitive personal information — we do not collect it, so no action is required
  • Non-discrimination — we will not deny services, charge different prices, or provide a different quality of service because you exercised a right


Categories collected in the past 12 months:
identifiers (name, email, IP address, cookie identifiers); commercial information (services inquired about); internet activity (browsing and interaction data); professional information (company, job title); inferences drawn from the above.

Categories disclosed for a business purpose: all of the above, to the recipient categories in Section 4.

Categories shared for cross-context behavioral advertising: identifiers and internet activity, to the advertising platforms in Section 4.

We do not sell personal information and have not done so in the preceding 12 months. We do not knowingly sell or share the personal information of consumers under 16.

To submit a request, email info@arktop.com with “Privacy Request” in the subject line. We verify identity by confirming information already on file and respond within 45 days, extendable by a further 45 days where reasonably necessary. You may designate an authorized agent, in which case we require written proof of authorization.

Other US states

Residents of Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, and other states with comprehensive privacy laws have rights similar to those in Section 6.2, including access, correction, deletion, portability, and opt-out of targeted advertising.

Contact us using the details in Section 1 and we will handle your request under the law applicable to you. If we deny a request, you may appeal by replying to our decision with the word “Appeal.” If we deny the appeal, you may contact your state attorney general.

How we protect information

We maintain administrative, technical, and physical safeguards appropriate to the information we hold, including:

  • SSL/TLS encryption (HTTPS) for data in transit
  • Role-based access to client accounts, limited to personnel assigned to that account
  • Multi-factor authentication on Google Workspace, Meta, Google Ads, and web-related platforms.
  • Confidentiality obligations for all staff and contractors


No system is completely secure. If we become aware of a breach affecting your personal information, we will notify you and any relevant regulator as required by law.

Automated decision-making

We do not engage in automated decision-making that produces legal or similarly significant effects concerning you.

Children

Our website and services are directed to businesses, not children. We do not knowingly collect personal information from anyone under 18. If you believe a child has provided us information, contact us and we will delete it.

Changes to this notice

We may update this page to reflect changes in our practices or legal requirements. We will revise the “Last updated” date above. Where a change materially affects how we use information we have already collected, we will provide notice before it takes effect.
